3. The service
AsbestosFlow is online software for recording and organising asbestos surveys. We grant you a limited, non-exclusive, non-transferable licence to use it while your subscription is active. AsbestosFlow is a recording tool; you remain responsible for the accuracy of your surveys and compliance with the Control of Asbestos Regulations 2012 and HSG264.
4. Your account
Keep your login details confidential and provide accurate information. You are responsible for activity under your account.
5. Acceptable use
- No unlawful, fraudulent or spam activity.
- No infringing others' intellectual property.
- No malware, probing, scraping or interfering with the security of the service.
- No reverse engineering, reselling or circumventing technical limits.
6. Intellectual property
We own the service, software, documentation and branding. You keep ownership of the survey data you enter and grant us a limited licence to host and process it solely to provide the service.
7. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
The plan costs £99.00 per month including VAT (£82.50 excluding VAT) after a 30-day free trial and renews monthly until cancelled. Payment, billing, tax, cancellation and refund terms are governed by Paddle's Buyer Terms. If you cancel, access to the app and your saved surveys ends immediately and is restored if you resubscribe.
8. Service level
We work to keep AsbestosFlow available but do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the service is provided "as is" without implied warranties.
9. Suspension and termination
We may suspend or end your access for material breach, non-payment, security or fraud risk, or repeated or serious violations of these terms.
10. Liability
Our total liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential losses, including lost profits or data. Nothing limits liability for fraud, death or personal injury caused by negligence.
11. General
These terms are governed by the laws of England and Wales, and its courts have exclusive jurisdiction. We are not liable for delays caused by events beyond our reasonable control.
